TERMS AND CONDITIONS OF SALE

Hereinafter referred to as “DISCIPLES” or the “Seller”.

2. PURPOSE AND SCOPE

These Terms and Conditions of Sale define the rights and obligations applicable to sales made through the website www.disciples-shop.com between DISCIPLES and any individual acting for non-professional purposes, hereinafter referred to as the “Customer”.

They apply to all orders placed through the website, to the exclusion of any other document.

The Customer acknowledges having read these Terms and Conditions of Sale before confirming their order. Confirmation of the order constitutes unconditional acceptance of these Terms and Conditions.

The applicable version is the version in force on the date the order is placed.

3. PRODUCTS

The essential characteristics of the products are presented on their respective product pages. Customers are encouraged to carefully review the descriptions, photographs, compositions, dimensions, fits, colours and size guides before ordering.

Product photographs and representations are provided with the greatest possible care. However, slight colour differences may occur depending on the screen used, photographic lighting or manufacturing characteristics.

The availability of sizes, colours and styles is indicated on the website at the time of ordering.

Most DISCIPLES items are manufactured or printed after an order is placed. Production may be entrusted to different specialised partners depending on the product, the customisation technique used, the destination and available production capacity.

This made-to-order production does not remove the Customer’s statutory right of withdrawal for standard products offered in the catalogue.

4. SIZE GUIDES

The measurements and recommendations provided in the size guides are intended to help the Customer make their selection.

As fits may vary between styles and manufacturers, the Customer should consult the size guide corresponding to the relevant product and should not rely solely on their usual size.

Reasonable manufacturing tolerances inherent to textile production may result in slight differences between the measurements stated and those of the product received.

5. PRICES

Prices are displayed in the currency applicable to the selected market and include all taxes where required by applicable regulations.

Any shipping costs, additional charges and applicable taxes are indicated to the Customer before final confirmation of the order.

DISCIPLES reserves the right to change its prices at any time. However, the product will be invoiced at the price displayed when the order is confirmed, except in the event of an obvious pricing error.

Any customs duties, import taxes or charges imposed by the authorities of the destination country may remain payable by the Customer where they are not included in the displayed price. Where such charges are foreseeable, the Customer is informed during the checkout process.

6. ORDER

The Customer selects the products, sizes, colours and quantities they wish to purchase and adds them to their shopping cart.

Before payment, the Customer may review the details of the order, its total price and correct any errors.

The order becomes final once the Customer:

  • confirms their shopping cart;

  • provides the required information;

  • accepts these Terms and Conditions of Sale;

  • confirms their obligation to pay;

  • and receives confirmation that payment has been approved.

An order confirmation is then sent to the email address provided by the Customer.

The Customer must verify the accuracy of their email address, delivery address, size, colour and product style ordered.

DISCIPLES cannot be held liable for any delay or inability to deliver resulting from incorrect or incomplete information provided by the Customer.

DISCIPLES may refuse or cancel an order in the event of:

  • payment failure or suspected payment fraud;

  • an obvious error relating to the price or product;

  • exceptional unavailability;

  • an abnormal or abusive order;

  • a previous dispute relating to payment for an order.

In such cases, any amounts already collected will be refunded.

7. AVAILABILITY AND MADE-TO-ORDER PRODUCTION

Products are offered subject to production capacity and the availability of materials, sizes and colours.

Once an order has been confirmed, it may enter production quickly. Any request to modify or cancel an order must therefore be sent without delay to support@disciples-shop.com.

DISCIPLES will make every reasonable effort to fulfil such a request but cannot guarantee that it will be possible where production has already begun or the order has already been sent to the production partner.

If a product becomes unavailable after the order has been placed, the Customer will be informed as soon as possible. The Customer may then accept an equivalent solution proposed by DISCIPLES or receive a refund for the unavailable product.

8. PAYMENT

Payment is due at the time the order is placed.

The available payment methods are those displayed during checkout. These may include bank cards, PayPal or any other payment method activated on the website.

Payments are processed by secure payment service providers. DISCIPLES does not store full bank card details.

In the event of payment refusal, payment failure, objection or suspected fraud, the order may be suspended or cancelled.

The Customer guarantees that they are authorised to use the selected payment method.

9. DELIVERY

Orders are delivered to the destinations available during checkout.

The applicable shipping methods, charges and estimated delivery times are displayed before the order is confirmed. They may vary depending on:

  • the product ordered;

  • the place of manufacture;

  • the supplier responsible for production;

  • the destination country;

  • the carrier;

  • the number of parcels;

  • and the selected delivery method.

The stated delivery timeframe may include both a manufacturing period and a transit period.

A single order may be produced by several partners and delivered in several parcels, without any additional charges that were not disclosed to the Customer.

Unless otherwise stated or agreed, delivery will take place no later than thirty days after the contract is concluded.

In the event of a delay, the Customer may request that DISCIPLES complete delivery within an additional reasonable period. If delivery does not take place within that additional period, the Customer may terminate the contract under the conditions provided by applicable law.

The Customer must provide a complete, accurate and accessible delivery address. Costs arising from reshipment due to an incorrect or incomplete address, an unclaimed parcel or an unjustified refusal of delivery may be charged to the Customer.

The risk of loss or damage passes to the Customer when they take physical possession of the product, except where the Customer personally selects a carrier that was not proposed by DISCIPLES.

10. RECEIPT OF THE ORDER

Upon receipt, the Customer is encouraged to check the condition of the parcel and products.

In the event of a damaged, defective, incorrect or missing product, the Customer should contact support@disciples-shop.com as soon as possible, stating:

  • the order number;

  • the nature of the issue;

  • and, where possible, photographs of the product and parcel.

Providing photographs facilitates the processing of the request but does not affect the Customer’s statutory rights.

11. RIGHT OF WITHDRAWAL

In accordance with the French Consumer Code, the Customer has fourteen days from receipt of the product to exercise their right of withdrawal without having to justify their decision.

Where several products from the same order are delivered separately, the withdrawal period begins upon receipt of the last product.

The Customer may use the model withdrawal form provided at the end of these Terms and Conditions of Sale, although this is not mandatory.

After notifying DISCIPLES of their withdrawal, the Customer has fourteen days to return the product in accordance with the instructions provided by DISCIPLES.

The direct return costs associated with exercising the right of withdrawal are payable by the Customer.

The Customer must handle and try on the product only to the extent necessary to establish its nature, characteristics and size. The Customer may be held liable for any reduction in value resulting from handling beyond what would normally be permitted in a store.

The product must be returned clean, unwashed and, where possible, with its labels and original packaging.

The absence of the original packaging does not automatically remove the right of withdrawal, but the Customer must adequately protect the product for its return.

12. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal may not, in particular, be exercised for goods made according to the Customer’s specific requirements or clearly personalised at their request, under the conditions provided by Article L.221-28 of the French Consumer Code.

This exception may apply, for example, to a product featuring a name, text, photograph or personal artwork requested by the Customer.

The mere fact that a standard DISCIPLES product is manufactured or printed after an order is placed does not make it clearly personalised and does not remove the statutory right of withdrawal.

13. REFUND FOLLOWING WITHDRAWAL

Where a valid withdrawal relates to the entire order, DISCIPLES will refund the amounts paid, including the initial standard delivery charges.

Any additional costs resulting from the Customer’s choice of a delivery method more expensive than the standard delivery method offered will not be refunded.

Where the withdrawal concerns only part of the order, the original delivery charges will only be refunded where they would have been lower had the returned product not been included in the order.

The refund will be made using the original payment method, unless the Customer expressly agrees to another method, and without any additional charge.

DISCIPLES may withhold the refund until it has recovered the product or until the Customer provides proof that the product has been sent back, whichever occurs first.

14. DEFECTIVE PRODUCT OR ORDER ERROR

In the event of a defect, damage, incorrect product, size or colour attributable to DISCIPLES or one of its partners, the Customer must contact customer service.

After review, DISCIPLES may offer, depending on the circumstances:

  • a replacement;

  • a repair where possible;

  • a price reduction;

  • or a refund.

Any costs necessary to process a product confirmed to be defective, non-conforming or sent in error will be borne by DISCIPLES.

These provisions do not limit the Customer’s statutory guarantees.

15. STATUTORY GUARANTEE OF CONFORMITY

The Customer benefits from the statutory guarantee of conformity under Articles L.217-3 et seq. of the French Consumer Code.

The Customer has a period of two years from delivery of the goods to obtain conformity of the product in the event of a defect that existed at the time of delivery.

The Customer may request repair or replacement of the product, subject to the cost and feasibility conditions provided by law.

The product must be brought into conformity at no cost to the Customer, without significant inconvenience and within a reasonable period that may not exceed thirty days from the request.

Where repair or replacement is impossible, refused, carried out outside the required period or causes significant inconvenience, the Customer may obtain a price reduction or terminate the contract under the conditions provided by law.

The statutory guarantee of conformity applies independently of any commercial warranty that may be offered.

16. GUARANTEE AGAINST HIDDEN DEFECTS

The Customer also benefits from the guarantee against hidden defects provided for by Articles 1641 to 1649 of the French Civil Code.

The Customer may bring a claim within two years from discovery of the defect.

Where the applicable conditions are met, the Customer may choose either to return the product and obtain a refund of the price or to keep the product and obtain a reduction in the price.

17. LIABILITY

DISCIPLES is responsible for the proper performance of the obligations arising from the contract, subject to the exemptions from liability provided by law.

DISCIPLES cannot be held liable for:

  • damage resulting from improper use or maintenance contrary to the instructions provided;

  • normal wear and tear of the product;

  • minor colour differences caused by the screen used;

  • inaccurate information provided by the Customer;

  • or an unforeseeable and unavoidable event attributable to a third party.

Nothing in these Terms and Conditions of Sale limits the mandatory statutory rights of consumers.

18. FORCE MAJEURE

Neither party may be held liable for a failure resulting from an event of force majeure within the meaning of French law and case law.

The affected party must inform the other party as soon as possible.

If the impediment is temporary, performance of the obligation will be suspended. If it becomes permanent, the contract may be terminated under the conditions provided by law.

19. INTELLECTUAL PROPERTY

The DISCIPLES brand, logo, texts, graphics, visuals, photographs, creations, patterns, videos and other elements appearing on the website are protected by intellectual property laws.

Any unauthorised reproduction, use, adaptation, exploitation or distribution, whether in whole or in part, is prohibited.

The purchase of a product does not transfer any intellectual property rights to the Customer.

20. PERSONAL DATA

Personal data collected when an order is placed is used to manage payment, manufacturing, shipping, delivery, customer service and compliance with legal obligations.

It may be transmitted to service providers strictly necessary for the performance of the order, including the e-commerce platform, payment service providers, made-to-order manufacturing suppliers and carriers.

Full details regarding the processing of personal data and the Customer’s rights are set out in the Privacy Policy available on the website.

21. EVIDENCE AND RECORD KEEPING

Electronic records stored in the systems of DISCIPLES and its service providers under reasonable security conditions may constitute evidence of communications, orders, payments and transactions between the parties.

The Customer is encouraged to retain their order confirmation and these Terms and Conditions of Sale.

Contracts concluded electronically for an amount equal to or greater than the statutory threshold are archived for the period required by applicable regulations. The Customer may request access to them by contacting support@disciples-shop.com.

The Customer is encouraged to provide their order number and describe their request precisely in order to facilitate its processing.

23. GOVERNING LAW AND DISPUTES

These Terms and Conditions of Sale are governed by French law.

Where the Customer resides in another country, they also retain the benefit of any mandatory consumer protection provisions applicable in their country of residence that cannot be contractually excluded.

In the event of a dispute, the Customer must first submit a written complaint to DISCIPLES in an attempt to reach an amicable solution.

If no amicable agreement can be reached, the Customer may refer the matter to the competent court in accordance with applicable legal rules. In particular, the Customer may bring proceedings before the court of their place of residence under the conditions provided by consumer law.

24. CHANGES TO THE TERMS AND CONDITIONS OF SALE

DISCIPLES may amend these Terms and Conditions of Sale at any time.

Any changes will apply to orders placed after the updated Terms and Conditions have been published online. Earlier orders remain subject to the Terms and Conditions accepted when those orders were confirmed.
